Terms and Conditions (T&Cs) are a set of rules and guidelines that govern the use of a service, product, or website. They are legally binding agreements between the service provider and the user or client. Here's a detailed explanation of what they typically cover:

  1. Credit Policy
  2. Although ODD does not offer credit terms as a general business practice, ODD, at its sole discretion, may offer terms to existing customers who are active on the monthly plan on a case by case basis.

  3. Payment Terms
  4. The Customer will receive an invoice with every case delivered detailing the products and associated fees incurred. Case fees are to be paid with the card on file with ODD and payment is processed at time of case submission. This includes shipping fees and any other ancillary fees that may be incurred depending on the case script and what is requested by the Customer or ODD. Customer must be current on the ODD monthly service fee schedule to gain access to ODD portal including patient info, scans, order history, etc. or to submit a case to ODD. ODD reserves the right to withdraw agreed upon monthly fees directly from Customer’s credit card and to keep credit card on file for case submissions and other purchases made by Customer from ODD.

  5. Warrenty
    1. What is covered:Subject to the terms and conditions set forth below, ODD offers a one-year warranty on removable products as follows: work is guaranteed to be free of defects due to materials and workmanship, and the appliance is guaranteed to fit if intraoral scans provided by customer are deemed satisfactory. The warranty runs from the date a restoration request is received by ODD.
    2. Exclusions:The following shall not be covered by ODD’s warranty: (i) restorations which cannot be returned to ODD; (ii) costs incurred for shipping; (iii) repairs resulting from accident, neglect, abuse, failure of supportive tooth structure or tissue structures, improper adjustments or dental hygiene; or (iv) restorations partially fabricated or completely fabricated by any lab other than ODD.
    3. How the Warrenty Works:How the Warranty Works: If during the applicable warranty period, Customer experiences any problems with its restoration that are covered by the warranty as described herein, then Customer may elect to receive as follows: (i) Credit – within 30 days of request by Client, a credit will be issued and applied to Client’s account; or (ii) Remake during the warranty period, ODD will remake the restoration (provided that if Customer elects to change the materials for such restoration, the original cost of the restoration will be credited and the new costs invoiced).
    4. Conditions:In order for Customer to receive the benefits of the warranty, Customer agrees as follows: (i) Customer must provide ODD with proof-of-purchase, including an invoice and patient name; (ii) the original dental restoration (including any damaged pieces) must be returned; (iii) the restoration must be inserted by a licensed, practicing dentist; and (iv) if ODD requests a new digital impression, but is instructed by Customer to proceed without the new impression, the warranty shall be null and void, and any further remakes will be completed at full cost

  6. Safety and Quality Information
  7. All products manufactured in the United States and use FDA 510K Cleared Materials

  8. Disclaimer, Limitation
  9. EXCEPT AS SPECIFICALLY SET FORTH HEREIN, ODD MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL ODD BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFIT, INCONVENIENCE, LOST CHAIR TIME, COSTS INCURRED WHEN REMOVING OR INSERTING RESTORATIONS, LOST WAGES, PAIN AND SUFFERING, BUSINESS INTERRUPTION OR OTHER PECUNIARY LOSS) ARISING OUT OF OR IN CONNECTION WITH THE PRODUCTS AND SERVICES PROVIDED BY ODD HEREUNDER.

  10. Client Responsibility
  11. No Liability to Patients. Customer shall supply ODD in writing with all specifications and information reasonably required by ODD to prepare the restoration requested by Customer. While ODD reserves the right to request further specifications or information, it expressly disclaims any duty to do so and may rely entirely upon the original specifications and information provided by Customer without any duty of investigation. Customer shall be solely responsible for the accuracy of any such specifications or information. Customer shall indemnify, defend and hold ODD and its officers, shareholders, and directors harmless from any and all claims, liabilities, and damages arising by reason of the treatment of any of Customer’s patients or the actual application, fit, alignment, or ultimate use of any restoration prepared by ODD or it’s contracted dental laboratories hereunder. IN NO EVENT SHALL ODD BE LIABLE TO ANY PATIENTS OF THE CUSTOMER FOR ANY DAMAGES RESULTING FROM ANY USE OF ANY RESTORATION OR OTHERWISE.
  12. Choice of Law, Venue, and Attorneys’ Fees.
  13. This Agreement shall be governed by the laws of the State of Florida without regard to its conflicts of laws rules. The parties consent to the exclusive jurisdiction and venue of the state and federal courts in St. Petersburg, FL for all matters and actions arising under this Agreement. If any proceedings are required to enforce any provision or to remedy any breach of this Agreement, the prevailing party shall be entitled to an award of reasonable and necessary expenses of litigation, including reasonable attorneys’ fees and costs.

ODD reserves the right to revise these terms and conditions at any time and to refuse service for any reason.
